PARTICIPATION CONDITIONS
Each participant travels at his own risk and waives all claims for personal injury and property damage against the skipper, crew or third parties, unless intent or gross negligence can be proven or damage is covered by liability insurance. This also includes the claims of indirectly injured parties who have or may have maintenance claims or service claims against a person on board by law. For reasons of safety and the undisturbed course of the trip, the instructions of the skipper must be followed. Participation is a holiday sporting activity, condition is healthy and swimmer. Not wearing a life jacket, even without a specific request, while sailing or anchoring is at your own risk. The skipper is entitled to exclude persons who permanently disturb or endanger the process at any time, even after warning. Any costs incurred by such a measure of any kind shall be borne by the person concerned. Furthermore, the person/s has no right to a refund of the travel price or part.
Payments
The participant alone is responsible for the punctuality of incoming payments. Non-payment of a due installment can be considered a cancellation by us. Services that have not been used but have been booked cannot be reimbursed. All invoices must be paid prior to commencement. If not, the contract becomes invalid. Participation With your registration, the conclusion of a sailing trip contract is bindingly offered. The contract is binding when we have received and confirmed your deposit. The registrant is jointly and severally responsible for the fulfillment of the obligations of all persons registered by him. Cancellation If a participant withdraws, we must be contacted in writing. If the participant withdraws from the travel contract or does not travel without a declaration of withdrawal, the following cancellation costs apply: processing fee up to 21 days after conclusion/contract: EUR 120 up to 151 days before travel: 10% of the total travel price,
150 days to 91 days before travel: 35 % of the total travel price,
90 days to 31 days before travel: 50% of the total travel price,
30 days/less before travel: 100% of the total travel price.
Rebooking
To avoid cancellation costs, you can provide appropriate replacements.
Withdrawal by the organizer
He is also entitled to withdraw if it is impossible to carry out the event due to special circumstances. In the event of problems with the ship, force majeure or similar events, the participant will receive the full amount back. Further claims, for whatever legal reason, are excluded. The operator is entitled to withdraw from the contract if the participant does not meet his payment obligations in good time. Compensation Claims for damages are generally limited to the amount of the rice price. The operator is not liable for situations that may arise as a result of repairs or other unforeseen events, such as weather conditions and force majeure. Defects must be reported immediately in writing. This applies to all claims. at event. due to storm, material damage or other reasons (not due to lack of care in relation to maintenance and repair), the yacht is not operational, then the participant can be expected to stay up to 48 hours per case of damage. If not operational, the remaining time will be reimbursed pro rata. Further claims are excluded. Assignment to third parties is excluded.
Insurance
The yacht has a COMPREHENSIVE, LIABILITY & SKIPPER LIABILITY. Personal belongings/luggage is not insured. The participants are only liable for personal damage caused intentionally or through gross negligence. We strongly recommend: luggage, travel accident, travel health and travel cancellation insurance.
Data protection
Notice according to data protection law: We store your data for our internal requirements. We undertake not to pass on your data to uninvolved third parties without your consent and to protect it against misuse.
